Disputes regarding Wills arise frequently when a person is inadequately provided for in a Will, where a Will does not meet the strict legal requirements for the Will to be valid, where the terms of the Will are uncertain, or where the terms of the Will cannot be carried into effect. Where these issues arise, often they must be resolved by the Court.
Similarly, if there is a dispute about the whether the trustees or executors appointed under a Will have complied with their strict legal duties, the Court may be ask to give directions to the trustees or executors, to appoint alternative trustees or executors or to order the trustees or executors to account to or compensate the beneficiaries.
